PARTNERSHIP DISPUTE LAWYER Although we would like that all business partnerships prove highly successful, with each the partners satisfied with the results of the partnership and the contribution of their fellow partners, the stark reality is that far too many partnerships given rise to a multitude of disputes, whether as a result of the partnership's failed business pursuits or due to disputes between individual partners. And when such disputes arises, it is imperative that they are resolved to the satisfaction of the respective partners, even if they must grudgingly compromise to something less than they would like. And given that court intervention isn't necessarily capable of imposing a comprehensive solution in most circumstances, it ultimately comes to the partners and their legal counsel to negotiate and implement a resolution that is capable of resolving the dispute. From the perspective of resolving partnership disputes, there are three scenarios within which business partners will find themselves and which will dictate how the partnership dispute is to be resolved. For the partners will either have (1) no written partnership agreement, (2) an inadequate written partnership agreement, or (3) a partnership agreement that specifically addresses the dispute that has arisen or, alternatively, provides a mechanism by which to resolve the dispute. In the first two scenarios, the lack of certainty combined with statutory law being exceedingly limited in its capacity to address partnership disputes, makes such matters subject to considerable negotiation and compromise, without which the partners will find themselves at an impasse, from which the advice and direction of an experienced lawyer is imperative. And even in the third scenario, where the partnership agreement provides specific written directions, facilitating its implementation all too often falls upon the lawyer and the legal pressure that can be asserted unto the opposing side.
